On Friday 8 March 2019, at 3:00pm GMT (10:00am EST), PwC is hosting a global indirect tax webcast, which will explore the impact on business of the Morgan Stanley case concerning recovery of VAT incurred by a branch in one EU Member State and used to support trading activities of a head office in a different Member State.

This global indirect tax webcast is relevant for all businesses that are established in multiple jurisdictions through branches. 

The ECJ's recent decision on Morgan Stanley (C-165/17) opens the door to determine multiple input VAT recovery rates based on the use of costs in different branches of a legal entity. This may lead to complex and extensive calculations. 

Businesses with branches and head offices in different Member States will have to consider carefully how the pro rata is to be determined in practice and what is to be included or excluded from the branch’s and, possibly, the head office’s pro rata calculations. Questions will be addressed from various regional points of view related to the recoverability of input tax, which is used by a branch in one territory to support a head office in another territory, where that head office makes supplies to external parties.
